the defendant is the scammer, the ebay auction was legit, it posted the carrier it can be used with, it posts the esn.. and why should the defendant get to keep the phone without paying for it? she’s the scammer

why? the charge was reversed. the woman did not pay for the phone, therefore the plaintiff is entitled to the phone. otherwise she gets it for free.

disagree. the average person does not know anything about ESN numbers,and would assume a phone being sold in america can be used in america. if the plaintiff was unaware that would be one thing. but legally she has to disclose any and all information about the phone.. including that it does not work in the united states

When the plaintiff purchased the phone she was mislead by the add. It never stated it could only be used with that specific carrier and it stated it could be used by her carrier hence why she bought it. Once she found out it couldn’t be used by her carrier she resold it on ebay stating the CORRECT CARRIER AND INFORMATION. This is no scam, it may be a little tricky but if you’re going to buy something do some fkin research. The ESN was listed. It’s legitimate.

If you buy a phone on ebay and it doesn’t work for your service reguardless if there is an ESN number listed which you are not knowledgeable about, that is not your fault. Nowhere in the listing does it state it works for this lady’s service, she took it for granted that it did and it was her mistake. If I buy a lazer for a pistol and when I get it I didn’t realize it doesn’t work on my pistol how could I complain to the seller? lol nonsense afaic!

Very silly girl… If the listing on ebay stated what the carrier was, then it’s not the sellers fault if the buyer can’t read. Fallow the rules of ebay buy either returning the item or file a claim. But most all READ THE DESCRIPTION and ask the seller questions, and if it seems to good to be true then it most likely is. It amazes me how people think that their stupidity should be paid for by other people.
Incompetence is NOT an excuse to stop payment..
